In the event that the domiciliary parent resides outside the United States, then the non?domiciliary parent shall have the right, upon application, to have legal custody of the minor child(men) on his, or her, own premises outside the United States and without a legal residence in the United States in certain circumstances or on travel on a temporary official passport or other document issued by an entity with a residence outside the United States. 2. In the event that the non?domiciliary parent is not lawfully present in the United States, or is not otherwise in compliance with Federal or State law, then the non?domiciliary parent may have, on his, or her own premises, the custody of his, or her, minor child(men) in accordance with the provisions of this subpart. b. Visitation shall be limited to daily periods in an environment which facilitates the physical and emotional development of the child. (1) The custodial parent shall provide the child, for at least 1 year of total visitation periods, with at least one and no more than two hours daily of supervised time spent by the child, with at least one hour of supervised time spent in a supervised setting and a minimum of 2 hours supervised time per day. (2) The daily time shall consist of periods of observation. (3) To the extent allowable by local law, the custodial child's relationship with the non-domiciliary parent shall be supervised, as provided by local law, as well as the relationship of the child to the other parent. (4) The non-domiciliary parent may have, on the child's own premises, supervised supervision of the minor child(men), including, without limitation: a. Attendance at school with a reasonable opportunity for him or her to have an unsupervised physical interaction with a substitute teacher and staff. b. Attendance at and participation in extracurricular activities, including, without limitation, a summer camp. c. Participation in a religious service, as long as the service does not involve the use of alcohol or controlled substances, tobacco, fireworks, weapons, or a simulated combat action. d. Participation in an athletic activity (other than participation in team sports), as long as the activity is supervised by the non?domiciliary parent and the child may participate in the activity without supervision as necessary to satisfy the activity requirements of the activity. e. Attendance at parent-teacher conferences. f.
