If you do not make arrangements for delivery, service will be provided by the national carrier. (B) The following persons are entitled to have a claim paid for by the carrier: (1) the passenger; (2) his or her agent; and (3) his or her employer. © Any person who fails to make payment in accordance with the terms of the policy or other authorized method of payment of any sum charged to his or her account shall be subject to the penalty of late payment and denial of any further insurance benefits for such period as may be specified in the policy. (d) A claim may be initiated by mail or by telephone. (e) The time for filing a claim shall be within four weeks after a shipment was lost or abandoned. (1) Where a shipment was lost, its contents were not identified, and the contents were discovered after the shipment was abandoned, and, the loss is attributed to theft, fraud or in the nature of a common carrier, negligence on the part of the shipper or person in charge of the shipment, the time for filing a claim for the loss shall be four weeks after such theft, fraud or negligence. All other cases, the time for filing a claim shall be within four weeks after the shipment was lost or abandoned. (2) A claim brought under the policy of insurance shall become effective with respect to the lost or abandoned shipment before any other action or proceeding is commenced. (f) The policy of insurance shall provide for the payment of a reasonable sum of money to cover losses of shipments for which a claim is filed. The insurance carrier shall not take possession of any contents of an abandoned shipment until all claims have been paid and the carrier has given notice to the insured of the action or proceedings. (g) The policy of insurance shall not be considered a policy of insurance until the carrier has issued a certificate under Section 749.03 that a shipper has made good all losses to a person other than the insurance carrier, as prescribed by such certificate. (h) If a carrier does not issue the certificate pursuant to Section 749.03 by the time the insurer has given notice of the action or proceedings in accordance with this Section, the insurer has the right to request the carrier to issue the certificate in writing which the carrier may do within twenty-four hours after the request has been received by the insurer.
