This case comes before the Court on the following claims: Defendant's allegations concerning Plaintiff are substantially the same as those made in other similar actions, that is, on claims for the failure to properly protect the public from toxic waste. The record in this Court contains no evidence of any failure to protect the public; and for many years, Plaintiffs and Defendant have operated without even the remote possibility of any threat to the public. The allegations are that the “in camera proceeding” (see supra, Docket No. 11-16-16) was filed fraudulently in an attempt to get a favorable settlement which would be unfair to Plaintiff. These allegations are based on hearsay and are wholly without basis in the record. Plaintiffs cannot prove that Defendant made any false statements about them or any “otherwise misrepresented any material fact in any way.” And, no such misrepresentation was made at the hearing at which the parties were asked to testify in person. There is also no record of any other proceedings, such as filings, that might have had an effect on Defendant's willingness to settle the case. There can be little doubt the facts are such as to establish a prima facie case of fraud against Defendant under section (a) of the Civil Rights Act of 1964. The court has heard testimony from a representative of the Vermont Office of the Attorney General (TAG), which provides legal support for municipalities and counties in these actions, and from Dr. David N. Capped. These documents were provided to the court by the defendants. It is not clear how much of N. Capped's testimony was based on actual facts, and how much of it was based on non-evidence or opinion (such as that a corporation has the characteristics of a person in a court action, when it cannot). The court has relied on it. Dr. N. Capped may have misrepresented facts and information. However, for a case that is alleged to have been filed fraudulently by Defendant, his opinion and testimony would not be of value at trial. Defendant may appeal his deposition in this case. Defendant contends the case is dismissed because Defendant failed to show his legal costs would have been unreasonable. Defendant also alleges Plaintiff is without standing because she is not an injured party to the conduct in question.
