Who needs a form I-9?

Form I-9 is for an employee who makes a statement that he did not provide false documents in his job application and for an employer who confirms that he has checked all the documents before hiring an employee.

What is form I-9 for?

The purpose of the employment eligibility verification form is to authorize citizens and noncitizens to work in the United States. It must be filled out at the very beginning of the employment and renewed if a contract or an alien registration number expires.

Is it accompanied by other forms?

An employee must provide several documents by which to verify his identity and employment authorization. There are three lists of necessary documents included in this form. An employee may file the documents from List A or submit the combination of documents from List B and List C. If an employee cannot submit the required documents, he may file acceptable receipts in lieu of those listed in this form.

When is form I-9 due?

An employer must complete Section 3 of this form if the employee’s USCIS number is expired or if he re-hires the same employee for the same position within three years since this form has been originally completed. If an employee changed his name, he must update Section 1. An employer must retain this form for three years after the hiring date or for one year after employment ends.

How do I fill out form I-9?

If you are employee, give the correct personal information and alien number in Section 1. Attach the documents from the list you’ve chosen. If you are a translator and you fill out this form for an employee, you have to give your personal information also. If you are an employer, examine the documents you received and fill in the table in Section 2. There is also Section 3 for updating and reverification.

Where do I send form I-9?

The form I-9 is to be retained at the office of the hirer because, according to USCIS, the employer is responsible for completing Section 1 timely and properly.
