The man, Albee said, fell to the ground with a gunshot to his thigh. “I just took two steps across the hall and I see the man with the gun. The cop went down, and I went over to the man in the doorway and asked him if he was all right,” Albee said. “I think he was shot in the leg.” Albee said he heard two “booms” or shots, then there was silence. “Just then the officer came running down, and I saw him with blood pouring down his leg, and he was sitting up in bed.” Albee said he was at the police station for an hour and said he left at 9:15 a.m. The man was taken into custody without incident, said Carpenter. The man, who Carpenter identified as Robert Lee Phillips, was charged with two counts of aggravated assault on a law enforcement officer, said Police Lt. Paul Williams. In the course of interviewing Phillips, however, Williams did not believe he had a shotgun, he said. Williams said he did not know what led to the shooting, but an investigation was under way. “I don't know if he was trying to harm anyone or harm the police,” Williams said. Phillips was arrested on charges of aggravated assault on a public servant. Phillips is the fifth person arrested since Sept. 18 because of the standoff. Each of the first seven has been released without charges. The fifth person was released after posting 75,000 bail and 10,000 cash. Albee said the man was friendly when he came out of the house. “He kept talking to every one of us and giving us a hug,” he said. “I don't know what his deal or plan was. I didn't know he was going to do it. “I don't know what motivated him, what he was trying to accomplish, if he had a plan here. All I know is that when he left, he was in a horrible condition and when I asked him if he was all right, he shook my shoulder.” Albee said he did not have any questions about the police's actions, but was worried about the man's condition. “You don't know where the hell he is,” he said. “I'm looking after my own guy. He came here to visit a friend and had a bad accident.
