1 (a) The Chief of Naval Operations shall ensure that all ships of the operating fleets which are operating in an operating area for an anticipated period of 1 year or more are: (i) in compliance with the requirements of this chapter and section 1250 of this title; (ii) operating in accordance with the operating plan for an area for which the plan is in effect; (iii) carrying out the operations required under paragraph (a) of this section in order to safeguard and support mission critical activities in that area; (iv) in accordance with the international obligations of the United States as specified in Annex XI of the Department of State, Bureau of Diplomatic Security, Washington, DC, and chapter 6 of part II of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1997, when the Secretary of Defense (or, when authorized by the Secretary, the Secretary of the department in which the Coast Guard is operating or which has jurisdiction over the area on which the ships or units are operating) determines that: (A) a significant increase in activities involving, or threatened by, unauthorized access to protected data occurs in an operating area; and (B) it is necessary to transfer the ships or units from the area to an area with an appropriate capability to protect such data; and (v) maintaining, as required by the operating plan, an adequate representation of United States citizens in the areas in which the ships or units are operating; (b) The Department of State, Department of the Treasury, and the Department of Defense (or, when authorized by the Secretary, the Secretary of the department in which the Coast Guard is operating) may conduct periodic or special assessment of the operating plan prepared under paragraph (a)(1)(i) of this section and recommend adjustments and modifications to the operating plan; (c) For the purposes of this section, the term “operating area” means any area which, under the terms of the operating plan, is subject to operational command by the department, department or agency that has national security responsibilities; and (d) The department shall, within the department's operating environment, assess the adequacy of the following with respect to the operating plan: (1) the training and readiness of enlisted and civilian personnel in accordance with part 15 and chapter 17; (2) the coordination of operations among the operating areas; and (3) the provision of transportation to and from operating areas, including by aircraft, by appropriate means that do not endanger civilian or military personnel.
