The legislation also amends section 24 of the Code of Virginia. The bill establishes a new disciplinary system by providing that a disciplinary committee will consist of two members, appointed by the governor, the attorney general, and the governor's chief legal counsel. It also creates a mandatory two-year suspension when a license holder: “(1) is employed or actively engaged in active practice, or practices at an institution of higher education, except as otherwise provided by law or rule, and; (2) has a previous disciplinary action issued by the board, the division or the Department; or (3) has been convicted of a felony, any crime of moral turpitude, or an act enumerated in the Code of Virginia, which was either a misdemeanor or a felony, or a similar offense, within two years before the date of such application for reinstatement.” Senate Bill 737 is scheduled to go into effect July 8, 2005. The bill is being sponsored by Del. Robert L. Burch (R-Culpeper). HOUSE EXISTING VERSION House Bill 1234 is currently in force for practicing physicians and surgeons who apply by May 1, 2005. House Bill 1234 (HB1234) (PDF) amends the Code of Virginia to require licensure boards to establish the procedures they are required to follow in disciplining registered nurses or certified nurse anesthetists who commit fraud (i.e., falsify certification) on their licensure application forms. Senate Bill 854 is currently in force for practicing physicians, osteopaths, and chiropractors who apply by July 1, 2005. SB 854 amends section 12 of chapter 13 of the Code of Virginia to provide for a one-year suspension of medical degrees obtained by a resident of another Commonwealth when the doctor is not licensed, when the resident has been convicted of more than one crime of moral turpitude, and when the resident is not licensed in the Commonwealth where the offense occurred. House Bill 1234 also requires that the boards establish such procedures prior to disciplining any physician licensed in the Commonwealth and any physician licensed in the Commonwealth in another jurisdiction; and that the board establish a two-year suspension. HOUSE EXISTING VERSION House Bill 875 establishes a new civil procedure for the court to obtain a temporary restraining order against an alleged perpetrator, the court to determine if there is probable cause to enter a restraining order, and when to commence a proceeding to enforce a restraining order.
