The person who wants to be a guardian or conservator must apply to the Probate Court to attain that position. The Probate Judge must then appoint an attorney to represent the person over whom guardianship or conservatorship is being sought.
To obtain guardianship over a minor child, you should file a petition for guardianship in the name of the minor child.Court Process Consent of Parents – If possible, consent of each parent must be obtained. Multiple Persons - Generally, a separate petition must be filed for each minor.
To appoint legal guardians for your children, you must name them as your chosen guardians in your Will. Before doing this you will need to approach the people you would like to appoint as guardians to find out whether they are willing and able to take on this responsibility.
