In order to legally broadcast on FM frequency bands you have to obtain a license from the FCC. There are two types FM radio licenses: LPM or Low Power FM (local) — These stations have a limited range and are only available to non-profit organizations.
Identify an available frequency in a specific location. Get permission to install an FM transmitter and antenna in that location. Submit an application form. Pay an $394 application fee. Participate in the auction process. If you're successful, pay the license fees. Install your transmitter and start broadcasting.
An application for a new license will cost $725. Main studio waiver requests will cost $1,110. License renewal applications will carry a $200 fee. And filing to sell a station will cost $1,110.
The low power licensee must be local. In order to apply within the first two years of the service, an organization must either have its headquarters or campus within 10 miles of the low power radio station antenna, or, 75 percent of its board members must live within 10 miles of the station antenna.
UNLICENSED LEGAL FM Regardless of popular misconceptions, it is not legal to broadcast on FM at low power, or at any power, without a license from the FCC. The section of the Federal Code of Regulations that regulates legal, unlicensed FM transmissions is Title 47, Part 15.
