The European Council will now assess the provisional application of the agreement on a case-by-case basis, taking into consideration the European Union's objective of advancing closer relationships with its nearest neighbor and will, if necessary, adopt an appropriate decision under the provisional application procedure. In order to take into account the specific circumstances of Antigua and Barbuda, as a low-tax jurisdiction (with a 10% corporation tax), the European Community will not apply the provisional application procedure in such a context. Moreover, in order to maintain existing economic and legal cooperation and facilitate the further opening up of trade, the European Community will, in the framework of the transitional arrangements, encourage the use of Antigua and Barbuda's financial services sector by European organizations and services as a springboard for further economic cooperation. At the same time, the European Community will ensure that the necessary arrangements of the provisional application of the agreement, as a transitional measure, shall be compatible with the relevant provisions of Article 15 of the Treaty on European Union. With regard to Grenada, Antigua and Barbuda and Barbados, Dominica, St Kits and Nevis the agreement on establishment of a Caribbean customs union with the European Community and the United States of America takes into account the special circumstances of Caribbean states. A similar agreement has been concluded with Antigua and Barbuda and Barbados. As in this context, the decision is necessary in order to ensure the continuity of economic and legal cooperation between these Caribbean states. In order to take into account the specific circumstances of Dominica, the European Community, in accordance with the decision of the European Council, will not provide, with effect from 1 April 2012, the necessary conditions and guarantees for the entry into force of a free trade area between Dominica and the European Union in the field of agricultural products. The agreement will therefore remain incomplete and the European Community will not apply the provisional application procedure on Dominica on a case-by-case basis. With regard to Trinidad and Tobago the agreement with the Member States provides for: transitional arrangements for the provision by those countries of certain transitional measures as soon as possible after entry into force, and provision of such transitional instruments as may be necessary from 1 April 2011, and; transitional arrangements for the provision by those countries of certain transitional measures as soon as possible after entry into force, and provision of such transitional instruments as may be necessary from 1 April 2012.
