(a) In general An initial discharge is authorized and shall consist of an amount of water, not to exceed 15,766,863 gallons, and a total annual average discharge volume of 466,500,000 gallons. (b) Releasing rights The operator of the facility shall have the right, subject to the requirements of the Federal Clean Water Act, to discharge from the facility under subsections (a), (b), (c), (d), and (e) without having to negotiate or enter into a contract with the Commonwealth for the discharge in accordance with the permit. © Authorization of annual average discharge Subject to subsection (f), the operator shall annually discharge in accordance with the permit an initially average volume of water sufficient to meet annual recreational fishing opportunities for fish that are listed in section 1006 in the Boston Metropolitan Region and the Cape Region. (d) Releasing rights (1) In general Subject to subsection (f), the operator of the facility shall have the right to discharge to the waters described by subsection (c) below an initially average volume of water sufficient to meet annual recreational fishing opportunities for fish that are listed in section 1006 in each of three designated river basins in the Boston Metropolitan Region and one designated river basin in the Cape Region to the maximum extent practicable and not in contravention of the interests of the Commonwealth as determined pursuant to the permit or the Federal Clean Water Act. (2) No liability The operator of the facility shall not be responsible for any damage to the recreational fisheries in a designated river basin, the Cape Region, or the Cape for that purpose. (e) Additional exemptions In addition to the exemptions provided in subsections (c), (d), and (c)(3) of section 803(g) of the Massachusetts Clean Water Act, and in accordance with the permit conditions, the operator of the facility shall have-- (1) the right to discharge to the Boston Harbor waters under the Massachusetts Harbor and Harbor Protection Act (16 U.S.C. 1131) for purposes of recreational fishing; and (2) the duty of care to minimize any incidental impacts to the recreational fisheries in designated river basins under subsection (f) of the Clean Water Act.
