The South Dakota Codified Laws have established a legal framework for using and accepting electronic signatures within the state. This framework is detailed in Title 53 - Contracts, Obligations & Property, Chapter 12 - Electronic Signatures and Records.

According to the law, electronic signatures are legally binding in South Dakota if they comply with the principles outlined in the legislation. eSignatures carry the same legal weight and enforceability as the traditional handwritten ones if they meet certain conditions. These include the intent of the parties to conduct transactions electronically, each party's consent, and the use of a method to sign that is capable of verification and accurately records the intent of the signatory.
