You must be equipped with ADS-B Out to fly in most controlled airspace. Any airspace that requires the use of a Transponder, described in 14 CFR 91.215, also requires aircraft to be equipped with a Version 2 ADS-B Out system.
Is ADS-B In required? ADS-B In is not mandated by the ADS-B Rule; only ADS-B Out is required in order to fly in the airspace mentioned in 14 CFR 91.225. At the present time, the FAA does not plan to mandate ADS-B In.
Pilots can submit an ATC authorization request via ADAPT for operations of an aircraft with an inoperative ADS-B system, per 14 CFR 91.225(g)(1), by selecting “ADS-B equipment repair” as the reason for the request.
Pilots/operators using aircraft that do not meet ADS-B Out equipage or performance requirements may request an authorization to deviate from the rule to access ADS-B Out rule airspace. The FAA has developed the ADS-B Deviation Authorization Preflight Tool (ADAPT) to manage these authorization requests.
The regulation 14 CFR 91.225(e) allows aircraft not certificated with an electrical system, including balloons and gliders, not equipped with ADS-B Out to operate within 30 nautical miles of a Class B primary airport—basically, within its Mode C veil—while remaining outside of any Class B or Class C airspace.
Pilots: Do you need ADS-B when flying under a Class B or Class C airspace shelf? If there is no Mode C Veil, ADS-B is not required to fly under a shelf of Class B or C airspace. If there is a Mode C Veil, ADS-B is required to fly under the shelf.
Without ADS-B Out, you can fly in any airspace except the ADS-B rule airspace defined by FAR 91.225 (see above). Note that ADS-B is not required in Class D airspace, or under a Class B or Class C airspace shelf, unless it lies within a Mode C veil.
