Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
However, all durable powers of attorney end when the principal dies. The executor of the deceased person's will -- or the estate administrator, if he died without a will -- must handle the sale of his mobile home, if that is necessary.
You do not get Power of Attorney for a deceased person. Depending on whether there is real property (house) involved, you may be able to have access to her account by Small Estate affidavit. You must wait 40 days after the death before you can exercise the affidavit.
In view of the aforesaid settled position of law, in case the GPA has been executed for consideration, the power of attorney is valid even after the death of the executing and you can still get the property registered on the basis of said GPA.
In case you ever become mentally incapacitated, you'll need what are known as “durable" powers of attorney for medical care and finances. A durable power of attorney simply means that the document stays in effect if you become incapacitated and unable to handle matters on your own.
Most states offer simple forms to help you create a power of attorney for finances. Generally, the document must be signed, witnessed and notarized by an adult. If your agent have to deal with real estate assets, some states require you to put the document on file in the local land records office.
In many states, a power of attorney must be notarized. The presence of a notary's stamp and signature is usually enough evidence that the power is a legitimate document. If you're concerned, run an internet search for the notary and ask him or her to verify that the stamp on the document is the notary's official seal.
Write the following text on the bottom of every page of the copy: I certify this is a true and complete copy of the corresponding page of the original lasting power of attorney. On the final page of the copy, you must also write: I certify this is a true and complete copy of the lasting power of attorney.
Most powers of attorney include the following language: A photocopy of this signed original shall be deemed to be, and should be accepted as, an original. A copy of a power of attorney that includes this provision will be accepted for most routine uses.
While you don't have to hire a lawyer to write a durable power of attorney, an estate planning lawyer can simplify the process.
What's the difference between durable and general power of attorney? A general power of attorney ends the moment you become incapacitated. When a power of attorney is durable, that means there's language within the document which states an agent's authority continues to apply if you become incapacitated.
A power of attorney is a legal document through which you, as the principal, name someone to have the authority to make decisions and take actions on your behalf. This person is called your agent or attorney-in-fact. Note that the person you name does not have to be an attorney.
Step 1: Bring Your Power of Attorney Agreement and ID. Step 2: Determine the Preferred Signature Format. Step 3: Sign as the Principal. Step 4: Sign Your Own Name. Step 5: Express Your Authority as Attorney-in-Fact. Step 6: File the Documentation Somewhere Safe.
First, it depends on what the terms of the Durable Power of Attorney state; if it's a general grant of financial authority, then the attorney-in-fact can do anything that you could do with a check written out to you, including depositing it in their own bank account.
