In basic terms, a photo release form is a contract between the photographer and the client, subject, owner of something in a photograph. Release forms secure legal permission to publish images of people and property.
When Do You Need a Photo Release Form? An image release form is required when the image will be used for commercial purposes. A simple way to determine if the usage is commercial is to ask yourself if the image is generating money; creating sales; or promoting a product, event, or idea.
Generally, photographers can publish photos of people on social media with or without a model release. However, it is advisable to not turn the posting into an advertisement for your services. Now you're using their likeness in an advertising medium, and you should be aware that a model release may be required.
Use business letterhead paper to create the document. State who owns the copyright. Describe and name the images(s) to be released. Explain the release usage.
An image release form is required when the image will be used for commercial purposes. If so, you definitely need a picture release form. If the image is being used for editorial purposes, accompanying a news article or journalism piece, a standard photo release form isn't necessary.
