If an employer says you must sign a separation agreement in order to get your last paycheck, they are in violation of the law, and could be in serious trouble. In the USA, all sorts of things might be included in a separation agreement, but the only things that are enforceable are those that comport with the law.
Unemployment benefits. In some states, you may agree to waive or forfeit your right to receive unemployment benefits in exchange for severance or the state's unemployment laws may disqualify you from receiving benefits for as long as your severance lasts.
Employers can use a separation agreement with employees who are fired or laid off. Employee separation agreements can have many names. They're also known as termination agreements; release of claims for employment; employment separation agreements; and severance agreements.

Q — Can I be forced to sign a separation agreement? A — No. A separation agreement is only valid if both spouses voluntarily agree to the terms and sign the document. Once the agreement is signed, it is a legally binding contract and can be enforced through the courts.
The law does not require a person to have a lawyer to create a separation agreement. Some spouses, citing expense, consider creating their own separation agreement without a lawyer. Separation agreements can be quite complex, as you might imagine.
A legal divorce in America usually begins with the husband or wife hiring a lawyer. An attorney is trained to handle the time-consuming work of bargaining a plan for child support, alimony, custody and property division with a client's spouse or the spouse's lawyer. However, a lawyer is not necessary in every divorce.
You have lived in NC for at least 6 months. You have been separated for at least 1 year. You do not want alimony or spousal support AND. You do not want a court-ordered division of property.
If you have lived in the state long enough to meet the residency requirements, you will first need to file a petition for a legal separation. Furthermore, you can either retain a lawyer to handle this for you, or you can fill out your own separation agreement using online resources or those provided by state court websites.
Most importantly, a legal separation agreement will protect you from being responsible for any debt your spouse acquires during the period of separation if you live in an equitable distribution state. If you live in a community property state, you don't get this protection under a legal separation agreement.
Even if it signed by both parties and witnessed, it is not considered a valid document in the eye of the courts, and therefore it can be overturned. A properly executed separation agreement has several factors.
Once a legal separation has been granted by the court system, you may still petition the court to have the motion of separation terminated. Visit your local Clerk of Court office and ask for a “motion to dismiss". You may also hire an attorney or use your divorce attorney to help you file the correct documents.
It is possible to amend or change a separation agreement, if both of you agree to it. It's a good idea to both get legal advice on the proposed changes. If you still agree after legal advice, then you can have the separation agreement rewritten.
