A severance agreement is a legal document that goes over all the responsibilities and rights of each party involved — the employee and the employer. If your severance agreement included a release, you may have given up the right to sue your former employer. Some employers offer severance to employees who lose their jobs. Often, however, employees who want a severance package have to sign a release or waiver, by which they give up their right to sue the company.

A: Usually when an employer offers you the option to resign in lieu of being fired they do so for a couple of reasons. One, because they think it will benefit you, since you will be able to say truthfully in the future when applying for other employment that you were not fired from that position.
