In addition to filing a response with the court, the tenant must attend the hearing in order to fight the eviction. At the hearing, the judge will listen to both the landlord and the tenant and make a final decision about whether the tenant should be evicted from the rental unit (see Wash. Rev. Code Ann.
When responding to the notice to quit, there are several options available to the tenant: Pay any delinquent rent that is due to the landlord within the allotted time of the notice. Move out of the premises within the allotted time of the notice. File an answer with the judicial court. File a motion to stay with the court.
Washington laws dictate that a tenant has 3-5 days to move out of the property depending on the reason for eviction. If the tenant is being evicted for failure to pay timely rent, they have 5 days to move out upon posting of the Writ of Restitution. For all other reasons, the tenant has 3 days only to move out.
The simplest way to respond to an eviction lawsuit is by filing a Notice of Appearance with the court and delivering (serving) a copy of it on the landlord.
To respond to the eviction case, you start with filling out an Answer or other response forms. Then, you file them with the court. This gives you the chance to tell the judge if there are any legal reasons your landlord can't evict you and tell your side of the story at a court trial.
Evicting a tenant in Maryland can take around three weeks to five months, depending on the reason for the eviction. If tenants request a continuance or file an appeal, the process can take longer.
For failure to pay rent cases the eviction process cannot start until 4 business days have passed from the time the court entered a judgment for possession in favor of the landlord. For breach of lease cases, or tenant holding over cases ( refuses to leave), the landlord may seek eviction immediately.
This notice informs the tenant that the tenant has three days to correct the violation or move out. If the tenant moves out within the three days, the landlord can't file an eviction suit, but can sue the (former) tenant for any rent owed or damage to the rental in an amount that exceeds the security deposit.
Responding to Eviction All answers must be in writing. No answer can be taken over the phone or received by fax. All answers must be filed in person. No one can bring your answer in for you. No additional days can be given by the court beyond the 7 days to file your answer.
