The four basic elements necessary for formation of a valid contract are capacity, offer and acceptance, consideration and compliance with law and public policy.
The agreement must be real and not be based on one party's deceiving another, on an important mistake, or on the use of unfair pressure exerted to obtain the offer or acceptance.
