Drafting the Roommate Agreement. State your names and the address of the residence. Start the agreement by writing the names of both roommates and the complete address of the residence, including the unit number of the apartment if you are living in an apartment building. A: Unfortunately, you don't have many great options. You both signed a lease, which means that each of you is responsible for paying the entire rent. While a house guest is not technically a tenant, certain tenant-landlord laws still apply to the relationship if they've been with your for more than 30 days. Talk to an attorney who will help you draft and send an eviction notice
When you want to evict a tenant who is occupying the premises on a month-to-month basis, give the tenant a 30-day notice to quit, get a summons for unlawful detained from the court, and appear at the hearing to argue the case. If you win, obtain a writ of possession and have the sheriff evict the tenants.
If the person resides there- even without a lease- you will need to file formal eviction proceedings with your local district court in order to legally remove that person from your home.
What is the difference between roommates and dependents? A roommate is a person who shares a unit with a tenant and pays part of the monthly rent. A roommate can have a Tenant Portal, a separate or combined lease, and can pay rent on the lease. A dependent is a person who lives with a tenant, but the rent is not split.
Tenants in Common In this situation, two (or more) roommates each have their own individual rental agreements in place with the landlord. When it comes to paying rent, each roommate pays the landlord the individual amount owed. If one roommate defaults on their payment, the other roommate is not affected.
