How legitimate are online divorces? Again, online divorces are just as legitimate and just as good of an idea as filing in-person at the courthouse, if your state allows it.
Online divorces are certainly legal, though they are not always recommended, especially if you and your spouse are facing a contentious divorce. If you and your spouse cannot agree on all major issues, then it's best that you involve an attorney.
First, check online to find your local divorce or family court. Their website will likely have forms you can download or print. You will need to get the forms to file for divorce as well as the forms to ask for a fee waiver. You can also go to the courthouse and get the forms from the clerk there.
The first thing you need to know about uncontested divorce is that you can do it alone or with the assistance of a lawyer. If you use a lawyer, the lawyer you get to do your uncontested divorce cannot represent both of you. Some jurisdictions may also require you to attend couples therapy prior to granting the divorce.
Uncontested divorces are generally available to couples who have no remaining disagreements regarding the basic divorce issues: child-custody, child support, property division, and spousal support. If the other spouse doesn't agree and makes the necessary court filings, an uncontested divorce cannot be granted.
Know which court to file in. Check with the county clerk or with an attorney to see if you meet your state's residency requirements. Fill out the divorce paperwork. Some states allow you to fill out the forms on a computer and submit online divorce papers.
Answer: In all states, the spouse asking for a divorce must file a divorce petition (or complaint) with the local court and complete service of process, by making sure the responding spouse receives copies of the divorce paperwork. In most states, the answer is no, you may not deliver your own divorce papers.
Uncontested Divorce If you properly served the divorce petition and your spouse filed an uncontested response, but won't sign off on the final divorce papers, courts in some states may allow the case to proceed as though it's uncontested. You may wait to be assigned a court appearance date.
In some cases, however, one spouse doesn't respond to a divorce petition. When a spouse doesn't respond to a divorce petition, the person who failed to file the answer to the court will lose his or her rights to make arguments about property division, support, and child custody.
One of the initial steps of a divorce is serving a Complaint for Divorce, also called divorce papers. Your spouse will only have 20 days from the date received to respond to the filed divorce papers. To ensure the papers were properly received, the court will not allow you to simply hand the documents to your spouse.
Spouses often refuse to sign divorce papers because they are uncomfortable with the language used and accusations made as part of a fault divorce. One way to prevent this problem is to agree to file the divorce under no fault grounds, after which you may find it easier to persuade your spouse to sign the papers.
When a spouse refuses to sign divorce papers, the spouse seeking a divorce will need to obtain what is called a contested divorce. To file a contested divorce, the party who wishes to obtain the divorce must file a petition in the family court in their jurisdiction.
The divorce process will end your marriage. You can only get a divorce if you've been married for at least one year. You might be able to get divorced without needing a solicitor or going to court if you and your ex-partner can agree you both want a divorce, and on the reason why.
