The ESIGN Act is a federal law passed in 2000. It grants legal recognition to electronic signatures and records if all parties to a contract choose to use electronic documents and to sign them electronically. No contract, signature, or record shall be denied legal effect solely because it is in electronic form.
An e-Disclosure is an agreement which is provided to the signer (consumer) by the requester (business) stating they agree to have their documents transmitted and receive electronically. It also includes the signer's rights regarding if they later withdrawal their consent and any consequences of this decision.
DESIGN treats commercial and consumer transactions differently, however. For commercial transactions, the parties' agreement to conduct the transaction will be implied from the facts and circumstances of the transaction or by an express statement of intent.
The UETA has been adopted by 47 states, the District of Columbia, Puerto Rico, and the Virgin Islands. The three states that have not adopted the BETA (New York, Illinois, and Washington) have all adopted similar laws making electronic signatures legally enforceable.
Contracts bind parties to their duties. Contracts can secure payment. No one likes to be stiffed for work performed and a binding contract provides a written legal document establishing an agreement to be paid for services rendered. Contracts provide recourse when the relationship falters.

For an electronic signature to be legally binding under the DESIGN Act, it is recommended that all electronic signature workflows include: Intent to sign. Similar to ink signatures, a signer must show clear intent to sign an agreement electronically.
The U.S. Code defines an electronic signature for the purpose of US law as “an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record.”
Thus in almost every state, wills and codicils have remained as more traditional legal documents requiring old-fashioned pen-to-paper signatures. Currently, Nevada is the only state that has adopted electronic wills capable of being signed electronically by their testators.'
Obviously, you cannot just take a picture of your signature on a piece of paper, crop it, and paste in your documents to use it for making the documents legal; this method will not provide any decent level of evidence as someone else can easily copy-paste it from your document to another document.
