The Photograph Professional photographers generally use a Model Release Form right at the outset of a photo shoot. You need permission to publish the photo for commercial purposes (e.g., you will get paid for your photo). It is generally accepted to snap a photo of a person in a public place without a release form.

Misconceptions on the Rights of Using Images. About 99.99% of the time, models do not have the rights to sell or publish the images they appear in. It usually takes a well-established veteran in the modeling business to know this, as so many models are just people who have their photos taken and post them online.
Generally, artistic expression is protected free speech, and photos which include a person and are published purely as artistic expression do not require a model release. Without the man's consent, you then make 10 large prints and sell them for $20,000 to $30,000 each, and you even put the photo in a book.
In the United States, a photographer can get in trouble for using someone's likeness commercially without a release form from the subject. Likewise, it is illegal for a client to commercially use images from a photographer without a photo release form.
Professional photographers generally use a Model Release Form right at the outset of a photo shoot. But this brings up an important point: the Model Release Form is not about granting permission to take the photos, but rather to publish them. You don't generally need written permission to photograph anyone.
Identify the releasor. Describe the photo, image, likeness, or video. Address any payment the model receives for the release. Address royalties. Address whether the model has the ability to revoke their authorization. The parties sign and date the release.
This type of form includes the information of both involved parties, details of the photos taken, signatures, and the date. The second kind is used for minor subjects, and must be signed by the subject's parent or guardian. This type of photo release is often called a model release form.
You do not need permission from someone to take their picture if they are in public view.
