However, in Florida, which is considered to be the most employer friendly state in the country when it comes to non-compete agreements, independent contractors are subject to covenants not to compete just like employees are.
Generally speaking, if a person or entity truly is an independent contractor, a non-compete clause or agreement will not be enforceable against him/her/it. But an independent contractor is in business for themselves and the services/products it provides you are its business.
If the time period of the non-compete agreement is too long, it may not be enforceable. Agreements of six months or less are presumed to be valid while agreements of more than two years are presumed to be invalid. However, with sufficient evidence, the court may find that an agreement of more than two years reasonable.
