For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
The simple answer is no. To be court ordered the agreement must be filed with the court and approved by a judge.
A notarized custody agreement, if never made an Order of Court, is not binding on the Court. An agreement signed by the parties can be used as evidence of the parties intent and most Court's will attach some weight to the agreement, but the Court is not bound to it.
A custody agreement that is filed with the court becomes a court order. A notarized agreement is one where the parties signed the agreement in front of a notary public. Be sure to talk to an attorney in your area as the law differs between states.
In most cases, parents can make their own agreements for custody and visitation, without a court order. If you make an agreement between the 2 of you, the agreement becomes binding and enforceable. But if 1 of you does not follow the agreement, a court cannot enforce it until it becomes a court order.
A document that's legally binding can be upheld in court. Getting the contract notarized proves each party signed the document (since no one can claim their signature was forged). The document has the notary's mark and seal.
In most cases, parents can make their own agreements for custody and visitation, without a court order. If you make an agreement between the 2 of you, the agreement becomes binding and enforceable. But if 1 of you does not follow the agreement, a court cannot enforce it until it becomes a court order.
If the parents agree on the changes, they can change their court order by using an agreement. But if the parents cannot agree on the changes, 1 of the parents must file papers with the court asking for a change (a modification) of your current child custody and visitation order.
A custody and visitation schedule. A holiday visitation schedule. Parenting plan and other provisions. Child support information. Anything else that will help you and the other parent raise the child.
You can write up your own custody agreement (on your own or with the other parent) or you can work with an attorney or legal professional and have them create it. Custody X Change is software that creates professional custody agreements and parenting schedules.
Traditionally, a standard custody agreement is a generic agreement that provides parents with basic parental rights and the accepted minimal amount of time with their child. A standard custody agreement typically gives one parent full custody while giving the other parent visitation rights. A child visitation schedule.
