Drafting the Roommate Agreement. State your names and the address of the residence. Start the agreement by writing the names of both roommates and the complete address of the residence, including the unit number of the apartment if you are living in an apartment building. Agree on the division of the rent payment.
A Roommate Agreement, sometimes called a roommate contract, is a contract between individuals residing together that outlines the terms, conditions, and responsibilities for each occupant, such as rent and utility payment amounts and dates, house rules and chores, and more.
Is a roommate agreement legally binding? Most of the agreement won't be legally binding. Your landlord has no power to enforce roommate agreements, nor does the Landlord and Tenant board. But if a serious dispute arises, you could end up taking your roommate to small claims court for financial damages.
If you have a roommate who will not move out when asked, then the only way you can legally get the roommate to move is to have the landlord win an eviction lawsuit against the roommate. You cannot generally file an eviction lawsuit yourself. Protect yourself, too, if your landlord decides to evict one roommate.
Get Another Roommate. If your roommate stops paying the rent but leaves, your landlord might allow you to find another roommate and allow the new person to take over the lease. Find Another Place. If you can't afford the rent on your own, you can arrange to move. Stay and Sue.
If one decides not to pay, then the other has to come up with the full amount. However, it does not mean that your roommate can demand that you terminate the lease. Just as you have agreed to pay that rent, your roommate has as well. But your roommate is still on the lease until the lease terminates.
When it comes to paying rent, each roommate pays the landlord the individual amount owed. If one tenant decides to move out, the remaining tenant is not affected in any way and will continue to pay only her agreed upon portion of the rent.
Find someone to take over the lease from your problem roommate. Break the lease and move somewhere else. Make the trouble roommate pay up.
You can contact the landlord to request that you are automatically released as a co-signer at the end of the lease term. If there is a relatively short period of time until the end of the lease term, many co-signers choose to wait until the lease concludes and then refuse to sign a new lease as a co-signer.
Talk to Your Co-Tenants. When you signed the lease, you took on certain legal responsibilities. Negotiate with the Landlord. As a matter of law, you cannot force the landlord to take your name off the lease until the lease ends. Find a Replacement Tenant. Get Legal Advice.
One year is most typical. If you break the lease, you're breaking a contract, and the landlord can hold you responsible for paying the rent until the end of your lease term. For example, if you pay $1,800 a month and want to break your lease for the last four months, you could end up on the hook for $7,200.
If your roommate gives you any kind of notice that he or she is leaving in mid-lease, then you may want to get him or her to sign an agreement stating that the departing roommate will: Pay the remaining rent and utilities. The amount of the rent will be depended on the terms of your lease. Find a substitute roommate.
If you paid rent and a portion of utilities while you were there, then you will likely have to pay the same portion for any time you were in the unit. If you have moved out AND have stopped paying rent, then it logically and legally follows that your obligation to pay a portion of the utilities also stopped.
The reason your roommate can sublet is that he has the same rights to the property that you have. One of those rights is to sublet. If the two of you didn't make any agreement (again, in writing) about how each person was going to occupy the apartment, then you have no basis (in the law) to stop your roommate.
In some circumstances it's acceptable to sublet a property, but tenants need their landlord's permission. Landlords can take legal action against tenants if they sublet their property unlawfully. Unlawful subletting includes if a tenant: sublets all or part of the property without written permission.
