For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
First, one spouse must have resided in California for at least six months before the filing. Next, that party must have been a resident of the county where the divorce is filed for at least three months. Remember, only one spouse must meet residency requirements to file a divorce in California.
Most couples divide custody, even if the children don't spend an equal amount of time with each. A parenting plan involves much more than visitation. Draft your parenting plan and have both parents sign it.
The first thing you need to know about uncontested divorce is that you can do it alone or with the assistance of a lawyer. If you use a lawyer, the lawyer you get to do your uncontested divorce cannot represent both of you. Some jurisdictions may also require you to attend couples therapy prior to granting the divorce.
If you want to get divorced without your spouse's consent, a no-fault divorce may be an easier option. That's because, in a no-fault divorce, the divorce papers do not name either of you as the party responsible for ending your marriage.
The answer, at least here in Texas, is that no, your spouse does not have to sign the papers. Sometimes there are papers your spouse may choose to sign; but there is no requirement under Texas law that your spouse must sign anything for you to obtain a divorce.
You Are Worthy of Love. Cultivate Positive Friendships. Remember Who You Were Before the Relationship. Take Time to Grieve. Get Re-Acquainted With Yourself. Explore All of Your Options. Celebrate Being single.
The answer is no, you cannot file without him getting notice and yes, you can divorce him without his consent. Without some type of service, the divorce will not go forward. So, as I said above, the answer is no, you cannot file for divorce without your husband knowing.
Not true. The judge must sign an order called a Final Decree of Divorce. In most of those cases, the judge will sign the Final Decree of Divorce at the same time the divorce is granted. Occasionally, even when the case is uncontested, the judge will require the attorneys to change something about the Final Decree.
Once the papers have been filed with the court, the question, “How long does an uncontested divorce take?” is completely out of the parties' hands. The amount of time it will take to finalize the divorce by having a judge approve and sign the judgment can take anywhere from six weeks to 12 months.
If you properly served the divorce petition and your spouse filed an uncontested response, but won't sign off on the final divorce papers, courts in some states may allow the case to proceed as though it's uncontested. You may wait to be assigned a court appearance date.
One of the initial steps of a divorce is serving a Complaint for Divorce, also called divorce papers. Your spouse will only have 20 days from the date received to respond to the filed divorce papers. To ensure the papers were properly received, the court will not allow you to simply hand the documents to your spouse.
If you properly served the divorce petition and your spouse filed an uncontested response, but won't sign off on the final divorce papers, courts in some states may allow the case to proceed as though it's uncontested. You may wait to be assigned a court appearance date.
You have 30 calendar days after service to file your response with the court and serve the Petitioner. It's generally a good idea to respond as soon as possible, as it's easy to miss a deadline when you procrastinate or become burdened with day to day life.
Divorce papers that have not been filed do not expire (whereas if a marital settlement agreement that has been filed but not ratified will be dismissed by the court for lack of record activity in 1 year). When you say you signed a petition I assume you also mean a marital settlement agreement.
To begin any divorce, you need to file the petition for a divorce with your local court. If, however, you change your mind soon after submitting these papers, you should go to the county clerk and ask for the petition. If it hasn't yet been filed, you may be able to withdraw it.
