Landlord Tenant Month to Month Lease Law and Legal Definition. A landlord wishing to terminate a month-to-month lease are often required to give written notice of termination at least a certain number of days before the end of the rental month (the month for which rent has been paid or should have been paid).
California law generally allows the owner to terminate a month-to month tenancy on 30 or 60 days notice, depending on how long the residents have lived there. By contrast, a fixed-term lease can only be terminated by the owner on three days' notice for cause.
You can give 60 days' notice as if you only had a periodic tenancy. To do this, you must first ask your landlord in writing to give you a standard lease to sign. If the landlord does so, you have 30 days to give your notice. If the landlord does not do so, you can give your notice after waiting at least 21 days.

Lease Agreements Landlords must provide tenants with at least seven days' written notice of termination when they pay rent every week. If you pay rent every month, and you did not sign a lease agreement, your landlord may need to give you at least 15 days' written notice before terminating your tenancy.
It is equally easy for tenants in Florida to get out of a month-to-month rental agreement. You must provide the same amount of notice (15 days) as the landlord. Be sure to check your rental agreement which may require that your notice to end the tenancy be given on the first of the month or on another specific date.
In most states, landlords must provide 30 days' notice to end a month-to-month tenancy. Except where noted, the amount of notice a landlord must give to increase rent or change another term of the rental agreement in a month-to-month tenancy is the same as that required to end a month-to-month tenancy.
If there is no written lease, the tenant may move out for no reason by giving written notice of the intent to leave no fewer than seven days before the next rent payment is due, if the rent is paid weekly, or 15 days, if the rent is paid monthly.
