For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
Filing the Assignment with the USPTO You are required to fill out the form and submit a copy of the executed transfer agreement in order to complete the assignment process the assignment is typically processed within one business day if filed online. There is also a $40 filing fee to record the trademark assignment.
Recording a patent assignment with the USPTO They can use the Electronic Patent Assignment System (ERAS) to file a Recordation Cover Sheet along with a copy of the actual patent assignment agreement. They should submit this paperwork within three months of the assignment's date.
In the IP field we typically use nun pro tunc in the context of an assignment of a patent, trademark or copyright. The nun pro tunc assignment becomes the subject matter for a blog post when someone back-dates an assignment to try to cure a standing defect.
Recording a patent assignment with the USPTO So the patent owner should record the assignment through the USPTO's Assignment Decoration Branch. They can use the Electronic Patent Assignment System (ERAS) to file a Recordation Cover Sheet along with a copy of the actual patent assignment agreement.
Trademark Assignment Process The assignment of a trademark occurs when assign or transfer the intellectual property rights to another person with or without goodwill. Assignee, the person who becomes entitled by the assignment of a registered trademark should apply for the trademark assignment in the prescribed manner.
A copyright assignment agreement must be in writing but need not be witnessed by a notary public.
Section 39 stipulates that an unregistered trademark may be assigned or transmitted with or without the goodwill of the business concerned. A request has to be made on Form TM-16 for an unregistered trademark to be assigned or transferred.
A trademark application may only be filed by the owner of the mark. There are many types of legal entities that can own a trademark. The most common that we see, and also the simplest, are LCS and corporations. Usually, a LLC or corporation develops a mark to identify itself as a source of goods or services.
In many cases, a business will want to start the trademark application as soon as their LLC or corporation paperwork is filed. By filing for a trademark prior to launch, you can be sure that your name is protected once you begin commercial sales. However, there may be an even stronger reason to apply early.
A patent assignment is a document transferring ownership of the patent application from one person/entity to another. It's possible to have a second assignment recorded for the same patent filing where the first company may transfer ownership to a second company or to an individual.
Individual Ownership. This can also get complicated. Either an individual or joint entities may own the entire right, title and interest of the patent. There are at least three possibilities — 1) there can be multiple inventors; 2) there can be multiple partial assignees; or 3) there may be a combination of 1) and 2).
There are advantages to assigning your patent rights to your company: Clarity. Assigning the rights means your company has a more clear right to make, use, and sell the product or service covered by the relevant patent or patents it's actually the right to exclude others from doing so.
You can search for federally registered trademarks by using the free trademark database on the USPTO's website. To start, go to the USPTO's Trademark Electronic Business Center at http://www.uspto.gov/main/trademarks.htm and choose “Search." Then follow the instructions you see on the screen.
Visit USPTO online. You can check to see if something is patented on the USPTO website, found here. From the main page of the USPTO website, open the Patents tab on the left side of the page. Click Search for Patents under the Patent & Tools Links.
