A default is a failure to comply with a provision in the lease. Curing or remedying the default means correcting the failure or omission. A common example is a failure to pay the rent on time. A landlord can also default by not performing certain responsibilities.
Lease Default means any event or condition which, with the lapse of time or the giving of notice, or both, would constitute a Lease Event of Default. Lease Default means any event which with the giving of notice or the lapse of time or both would become a Lease Event of Default.
In landlord-tenant law, default refers to the failure of a tenant to timely pay rent due. Landlords often require a background and/or reference check on prospective tenants in an attempt to minimize defaults in rent payments.
Default. An omission. A failure to do that which is anticipated, expected, or required in a given situation. To default on a debt is to fail to pay it upon its due date. Default in contract law implies failure to perform a contractual obligation.
Can I Walk Away From a Commercial Lease? Technically, you can move out of the office and into new premises. However, if you abandon the premises without plans in place with your landlord, you will be legally responsible for: the landlord's costs in re-letting the property.
If you do not pay the amount of rent that is due every month, the landlord can go to court to evict you. To do so, the landlord must first send you a letter stating that unless all the rent due is paid, the landlord will terminate the lease and take you to court. This letter is often called a “Five Day Letter.”
If the lease remains in arrears for three months without any attempt to pay off the debt then your vehicle could be marked for repossession. The finance company will have exhausted all other options to assist you in honoring the terms of the lease. So the only option remaining is for them to repossess the car.
Make sure that the tenant is in default. Many leases contain conditions precedent to default like notice requirements. There may be non-monetary breaches that require some notice but that allow a landlord to evict a tenant.
