Can you notarize something that's already been signed?
As long as the signer is personally present before the notary and acknowledges the signature, then the notary can proceed with performing the notarial act. If the document has already been signed, the signer can sign his or her name again above or next to the first signature. You can then proceed with the notarization.
What happens if you notarize something incorrectly?
What happens if a notary makes a mistake? The National Notary Association suggests that even the smallest mistake could have dire consequences. The notarized document could get rejected. A mistake that results in a rejection can result in late fees and penalties on the part of the client.
Does a document have to be signed in front of a notary?
To get something notarized, you must sign it in the presence of a notary public. The notary must actually watch as you sign the document. So, DO NOT SIGN your document before meeting the notary public. The notary will either refuse your document or require that you sign it again in front of them.
Do both parties need to be present to notarize a document?
Do all parties have to be present at the same place and time for a document to be notarized? Usually not, but it is best to ask your selected notary regarding the proper procedures in your state.
How do you sign a notary?
Step 1: Personal appearance is required. Under California law, every signer must personally appear before you at the time of the notarization.
Step 2: Check over the document before notarizing.
Step 3: Carefully identify the signer.
Step 4: Complete your journal entry.
Step 5: Fill in the notarial certificate.
Can you notarize an electronic signature in New York?
New York's Electronic Signatures and Records Act allows electronic notarization for real property documents. The signature, seal, and certificate must be attached to or logically associate with the document or signature being notarized and follow the PRI Notary version 2.4.
Can I notarize an electronic signature in Texas?
Any Texas notary may perform an electronic notarization. An electronic notarization must meet all the requirements of any other notarization, such as the requirement that the signer personally appear before the notary to acknowledge the document.

You may notarize a document that does not have preprinted notarial wording as long as the signer tells you what type of notarization is needed. As nonattorneys, Notaries cannot decide the type of notarization to perform on a document because the choice can have important legal ramifications.
Can you notarize a document without a stamp?
All 50 states require public notaries to place their respective stamp on documents as a means to finalize and authenticate the service. Without this stamp, the document is not legally notarized. Placing the notary stamp over the signature may void the document, negating the notary's work.
