Both succeeding and superseding leases establish new terms and conditions and result in a new lease contract with an existing Lessor. Succeeding and superseding leases are distinguished from other lease actions to fulfill a continuing need for space, such as a replacing lease.
For example, if a person leases premises for the stated purpose of using the building as a place to make illegal drugs, the agreement is void and unenforceable. Also, if the law doesn't consider a person competent to enter into a contract, the lease is void. Leases are also void if they are against public policy.
The Unfair Terms in Consumer Contracts Regulations make any clause which is 'unfair' null and void in a court of law. So if a term or condition of the tenancy agreement is giving either party less than their statutory rights, then it can't be enforced, and it won't hold up in a court of law.
A tenancy agreement is just like any other contract, so as soon as both the tenants and landlord have signed the agreement, it becomes a legally binding contract. The contract will usually specify the move in date for the tenants and the date when the first rental payment is due.
In addition to the basic conditions, leases that require tenants to waive their rights to their security deposit or to sue the landlord are considered invalid and unenforceable. Leases also must not contain language that absolves the landlord from their obligation to keep the property safe and habitable.
A lease is automatically void when it is against the law, such as a lease for an illegal purpose. In other circumstances, like fraud or duress, a lease can be declared void at the request of one party but not the other.
If a person has no lease, he/she may be evicted with proper notice. Landlords may sue for unpaid rent as well as fair compensation for any holdovers' use and occupancy after commencement of proceedings.
If your lease does not say that it automatically renews when the lease term ends, your landlord can go to court without giving you any notice. They can only do this during the seven days following the end of your lease term.
