While unlocking is not illegal per se, many cell phone companies lock devices they sell under contract or on an installment payment plan. And this is done because they want to make sure the money is made on subsidized devices. And of course, mobile providers want to make it hard for you to unlock such a device.
You'll have to wait until your contract is up before you can unlock your phone. There's an exception, however -- if you're willing to pay an early termination fee on your contract, you'll then be eligible. So if you owe money, your carrier doesn't have to unlock your phone.
If you bought your phone outright, it's considered a “prepaid” device and can be unlocked one year after its initial activation. So if you owe money, your carrier doesn't have to unlock your phone. In either case, if your phone is eligible for unlocking, your carrier has to notify you.
Your carrier may refuse to unlock your phone if: Your phone has not been paid off in full. You have any past due payments or unpaid balances with your carrier. Your phone is reported lost or stolen. You haven't met their unlocking requirements.
What Happens If You Sell a Phone That Isn't Paid Off? If you do, your carrier will blacklist your phone also known as giving it a bad ESN or IMEI number. This number is accessible to other carriers too, which means they may not activate your phone on their network if it carries a blacklisted IMEI or ESN number.
Normally, when this situation happens, doing a factory reset of your phone is one option to regain access. But this will lead to total loss of all data on your phone. Then, is there any ways to unlock locked Android phones without losing data. The answer is absolutely yes.

Thanks to the Unlocking Consumer Choice and Wireless Competition Act, it's perfectly legal to unlock your phone and switch to a new carrier. Unlocking your phone is legal, but some restrictions, as they say, may apply. If you have a prepaid phone, carriers can't lock you in for more than 12 months.
