For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
Wage garnishment happens when a court orders that your employer withhold a specific portion of your paycheck and send it directly to the creditor or person to whom you owe money, until your debt is resolved. Child support, consumer debts and student loans are common sources of wage garnishment.
To start the wage garnishment process, file a Writ of Execution with the sheriff in that county. This authorizes the sheriff to inform the debtor's employer that a portion of his employee's wages need to be withheld from his paycheck each pay period until the debt is settled.
Wage Garnishment Procedure. A creditor begins the wage garnishment process by filing a Request for Garnishment on Wages (Form DC/CV65) with the court. After the request is filed, the court clerk or a judge signs the Request, and it becomes a Writ of Garnishment.
Federal law places limits on how much judgment creditors can take from your paycheck. The amount that can be garnished is limited to 25% of your disposable earnings (what's left after mandatory deductions) or the amount by which your weekly wages exceed 30 times the minimum wage, whichever is lower.
If debtors do not make good on their obligation, a creditor can file a request for a garnishment to seize part of the debtor's wages. The same process, when used against a bank account instead of a paycheck, is called a “levy” instead of a garnishment. Obtain an order of judgment from a district court.
(When it comes to wage garnishment, disposable income means anything left after the necessary deductions such as taxes and Social Security.) Either 25% or the amount by which your weekly income exceeds 30 times the federal minimum wage (currently $7.25 an hour), whichever is less.
Respond to the Creditor's Demand Letter. Seek State-Specific Remedies. Get Debt Counseling. Object to the Garnishment. Attend the Objection Hearing (and Negotiate if Necessary) Challenge the Underlying Judgment. Continue Negotiating.
You must take action to prevent the initial garnishment or address it if it has already started by claiming an exemption with the court. The creditor will continue to garnish your wages until you pay the debt in full or take some measure to stop the garnishment, such as by filing for bankruptcy (see below).
