When you change your business name, you generally do not have to file for a new EIN. Instead, you submit an EIN name change. If you change your name soon after you file your annual tax return, then you can inform the IRS of the EIN number change name through a signed notification, similar to a sole proprietorship.
If the EIN was recently assigned and filing liability has yet to be determined, send Business Name Change requests to IRS, Stop 6055, Kansas City, MO 64999. In some situations a name change may require a new Employer Identification Number (EIN) or a final return.
Beginning January 1, 2014, any entity with an EIN, such as a plan sponsor, must report a change in the identity of their plan's responsible party on Form 8822-B, Change of Address or Responsible Party — Business, within 60 days of the change.
To transfer EIN to new owner isn't possible. Wins, or Employer Identification Numbers, are not transferable from one business owner to another. There are circumstances in which a business owner may need a new EIN, however.
Generally, businesses need a new EIN when their ownership or structure has changed. It is not possible to use the same EIN for different Entity types or for businesses that are not related. Because these types of businesses fall under different tax rules, they require separate Wins.
